Terms of Service

These are the terms that govern your use of Smilee. We've tried to keep them as plain and fair as the rest of the product.
1. Acceptance of terms
By applying to, or using, Smilee, you agree to these Terms of Service and our Privacy Policy. If you don't agree, please don't use Smilee.
2. Who can use Smilee
Smilee is invite-only during the Founding 1,000 phase. You must be at least 18 years old to apply — this matches the age of majority and contractual capacity under the Indian Contract Act, 1872, so that these Terms are legally binding on you. Each person may hold one Founding Member account.
3. Your account
You're responsible for the accuracy of the information you give us and for keeping your login credentials safe. Let us know immediately at hello@smilee.co.in if you believe your account has been accessed without your permission.
4. Acceptable use
Smilee is built for genuine, respectful relationships. In line with the IT (Intermediary Guidelines) Rules, 2021, you agree not to upload, store, or share content on Smilee that:
- Is harassing, threatening, defamatory, obscene, or invasive of another person's privacy.
- Impersonates another person, or is knowingly false or misleading.
- Infringes someone else's intellectual property or other legal rights.
- Contains malware or anything designed to harm Smilee or its users.
- Is unlawful in any other way, or threatens public order or the security of India.
You also agree not to:
- Use Smilee to harass, pressure, or spam anyone — including people in your own Circle.
- Add someone to your Circle to contact them on Smilee's behalf without their knowledge.
- Attempt to access another member's account or data.

5. Your content
You own everything you create on Smilee — your Moments, notes, and Circle. You grant us only the limited license needed to store it securely and show it back to you. We don't use your content for advertising, and we don't share it publicly.
If you believe content on Smilee violates your rights or these Terms, write to our Grievance Officer (below) and we'll review and, where appropriate, remove it — generally within 15 days, or within the shorter timelines the law requires for specific categories (for example, on receipt of a court or government order).
6. The Founding 1,000 program
Applying to the Founding 1,000 doesn't guarantee acceptance. Founding numbers are assigned in the order applications are approved. We may ask you to complete a small "Smile Challenge" — one genuine gesture toward someone who matters — before your spot is confirmed.
7. Termination
We may suspend or close an account that violates these Terms or our Community Guidelines. You can also close your own account at any time by writing to us — we'll delete your data per our Privacy Policy.
8. Disclaimers
Smilee is provided "as is." We work hard to keep it reliable, but we can't guarantee it will always be error-free or uninterrupted. Smilee is a tool to help you reach out — it doesn't substitute for real relationships, and we're not liable for the outcome of any conversation it prompts.
9. Changes to these terms
If we update these terms in a meaningful way, we'll update the date above and notify Founding Members directly.
10. Governing law & jurisdiction
These terms are governed by the laws of India. Subject to that, the courts of Mumbai, Maharashtra shall have exclusive jurisdiction over any dispute arising from these Terms or your use of Smilee.
11. Grievance Officer
In accordance with the IT Act, 2000 and the IT (Intermediary Guidelines) Rules, 2021, complaints about content or conduct on Smilee can be raised with our Grievance Officer:
